These are the terms for using Nightwatch, in plain words. By creating an account or subscribing, you agree to them.
What Nightwatch is
Nightwatch is a sound monitor that runs in your browser. It measures the sound in your room against the room's quiet, logs each sound and keeps a short clip of it on your device. It does not understand words and does not know who makes a sound. It is not a safety device, not a certified smoke or carbon monoxide alarm, and its levels are not a legal noise measurement. A Mac version is being built and is not part of what you buy today.
Your account
You need an account with a working email address. Keep your password to yourself; what happens under your account is your responsibility. One account is for one person.
Subscription and payment
Nightwatch is sold as a subscription: US$12 a month or US$99 a year, at the price shown when you subscribe. It renews at the end of each period until you cancel. Stripe takes the payment, and we never see your card number. Prices may change; a change applies from your next renewal, and we tell you by email before it does.
Cancelling and refunds
Cancel any time from your account page. Your subscription then runs to the end of the period you have paid for, and no more is charged. If Nightwatch is not for you, email us within 14 days of your first payment and we refund it in full. After that, payments are not refunded. Free months bought with loyalty points have no cash value and are not refunded.
Loyalty points
Points are a thank you, not money. They have no cash value, cannot be transferred or sold, and end with your account. We may change how points are earned or spent; points you already have keep their value for a free month.
Your recordings, and other people
Your recordings are yours and stay on your device. Recording laws differ from place to place, and following them is up to you: if other people share the room, tell them Nightwatch is listening. Do not use Nightwatch to record anyone whose agreement is required and not given.
Stories and reviews
A story or review you send us must be your own and true. We publish it only if you tick the box that allows it, with the name you give, and we may stop publishing it at any time. You can ask us to take it down.
Fair use
Do not try to break into the service, copy it, resell it, or use it in a way that harms others or breaks the law. We may close an account that does.
What we promise, and what we do not
We work to keep Nightwatch running, but we do not promise it will be available at every moment or that it will catch every sound. A sound can be missed, and a level can be off. To the extent the law allows, we are not liable for a sound Nightwatch missed or misjudged, or for any indirect loss, and our total liability is limited to what you paid us in the twelve months before the claim.
Changes and law
We may change these terms; we tell you by email before a change that matters, and the new terms apply from then. Ontario law governs these terms, and its courts decide any dispute. If you close your account, or we close it under these terms, your subscription ends and your data is deleted as the privacy notice says.
